Directive (EU) 2024/825 · Annex I to Directive 2005/29/EC ·Applies from 27 September 2026

The twelve practices banned in all circumstances

Directive (EU) 2024/825 inserts twelve new points into Annex I to Directive 2005/29/EC — the list of commercial practices that are unfair in all circumstances, where nobody has to show that the average consumer was materially affected. Five concern environmental claims, including sustainability labels and carbon-offset claims. Seven concern software updates, durability and repair. Member States had to adopt the measures by 27 March 2026 and apply them from 27 September 2026. This free tool sets out all twelve verbatim in your language, under the point numbers your own Official Journal uses, and records the answer you give against each one. It does not decide whether your practice is lawful.

What you are checking

The numbering below is the EU numbering of Annex I to Directive 2005/29/EC. A Directive binds through national law, so the provision you are actually subject to sits in your own consumer legislation and will be numbered differently there. The wording is reproduced from the Official Journal in the language of this page.

This records a check. It does not answer it. Whether something is a generic environmental claim, whether you can demonstrate recognised excellent environmental performance, and whether a feature was introduced to limit durability are judgements with edges, and they are yours to make. Penalties are set by national law and are not shown here. Informational only, not legal advice.
